1.About these terms
These terms apply to your use of Restaurant OS, a service operated by The Research Desk (“we”, “us”). By creating an account or using the service, you agree to them on behalf of yourself and the restaurant business you represent (“you”).
Please also read our Privacy Policy and Refund Policy, which form part of these terms.
2.The service
Restaurant OS is web-based software for running a restaurant: a branded ordering site, POS, kitchen display, delivery, inventory, staff, customers, loyalty, promotions, reporting and billing. Which features you can use depends on your plan. We may improve, change or retire features over time; if a change significantly reduces what your paid plan includes, we will tell you in advance.
3.Accounts and access
- You must give accurate information and be authorised to act for the restaurant you register.
- You are responsible for your account, for the staff you invite, and for the roles and permissions you give them.
- Keep passwords safe and tell us promptly at info@theresearchdesks.com if you think your account has been misused.
4.Free trial and plans
New restaurants start with a free trial (currently 14 days). No payment details are needed to start it.
When the trial or a paid period ends, an invoice is issued for the next period of your plan. You can request a different plan from Billing in your dashboard; a new invoice is issued for it and the new plan applies once that invoice is paid.
5.Fees, invoices and payment
- Plan prices are shown on our website and in Billing. Each period has its own numbered invoice with a due date.
- Today, payment is made manually: you pay by bank transfer, Easypaisa, JazzCash or another method listed in Billing, then upload proof of payment. We review it and mark the invoice as paid, or tell you why it was not accepted.
- Nothing is charged to you automatically.
- If an invoice is not paid when the period ends, your subscription becomes past due and you have a 7-day grace period. If it is still unpaid after that, your restaurant is suspended until the invoice is paid. Paying the open invoice restores access.
- Prices do not include any taxes or bank or transfer charges that apply to your payment, which are your responsibility.
- Fees are non-refundable as described in our Refund Policy.
6.Cancellation
You can stop using Restaurant OS at any time. Because nothing is charged automatically, you are never billed for a period you have not chosen to pay for.
- To cancel, open Billing in your dashboard and choose Cancel subscription (available to users with billing permission), or email info@theresearchdesks.com from the account owner’s email address. You can withdraw a scheduled cancellation from the same place until the period ends.
- Your access continues until the end of the period you have already paid for. After that, the subscription ends and no further invoices are issued.
- If you simply stop paying, any open invoice stays unpaid and the restaurant is suspended after the grace period described above.
- Cancelling does not delete your data straight away. After cancellation, or if you ask us to delete it, your data is deleted within one month (30 days), except records we must keep, such as invoices for accounting. See our Privacy Policy.
- If you would like a copy of your data before it is deleted, ask us when you cancel.
7.Your content and guest data
You own the content you put into Restaurant OS, such as your menu, photos, branding and business data. You give us permission to host, copy and display it only as needed to provide the service to you.
You are responsible for the guest data you collect through your ordering site, and for having a lawful basis to use it. We process it on your behalf as described in our Privacy Policy.
8.Your responsibilities as a restaurant
Orders placed on your ordering site are between you and your guest. You are responsible for:
- your menu, prices, taxes, allergen and dietary information, and promotions;
- preparing, delivering and handling orders, and any refunds or complaints from your guests;
- collecting payment from your guests, including cash collected by riders;
- following the laws that apply to your business, including food safety, consumer and data protection rules.
9.Acceptable use
Do not use Restaurant OS to:
- break the law or infringe anyone’s rights;
- send spam or misleading messages to guests;
- try to access another restaurant’s data, get around limits or permissions, or disrupt the service;
- copy, resell or reverse-engineer the service except where the law allows it.
We may suspend accounts that break these rules or put the service or other users at risk.
10.Our intellectual property
Restaurant OS, including its software, design and documentation, belongs to The Research Desk. Your subscription gives you the right to use it for your restaurant while your subscription is active; it does not transfer ownership.
11.Availability and support
We work to keep Restaurant OS available and reliable, but we cannot promise it will always be uninterrupted or error-free. We may need to carry out maintenance, and we depend on third-party infrastructure. For help, email info@theresearchdesks.com.
12.Disclaimers and limitation of liability
To the extent the law allows, the service is provided “as is” and we do not give warranties beyond those stated in these terms.
To the extent the law allows, we are not liable for indirect or consequential losses, such as lost profits, lost revenue or lost data, and our total liability for any claim relating to the service is limited to the fees you paid us for the service in the 12 months before the claim.
Nothing in these terms limits any liability or rights that cannot be limited under the law that applies to you.
13.Suspension and termination by us
We may suspend or close an account for unpaid invoices (as described above), for serious or repeated breaches of these terms, or where required by law. Where it is reasonable to do so, we will warn you first and give you a chance to fix the problem.
14.Governing law
These terms are governed by the laws that apply where The Research Desk operates, without affecting any mandatory rights you have under the law of the place where you live or run your business. We would always prefer to resolve a disagreement by talking first, so please contact us.
15.Changes to these terms
We may update these terms from time to time. We will change the “Last updated” date above and, for significant changes, notify account owners before the changes take effect. If you continue to use the service after that, the updated terms apply.
